И да и нет, все будет упираться в наличии доказательств и окончательной оценки прокурора (с помощью работы адвокатов естественно) С одной стороны потерпевшей будет женщина, обвиняемым будет наркоман а третье лицо которое решило проявить самооборону по отношению к себе или другим особям то его действия будут оправданы . И тут самое интересное начинается, Пропорциональность самобороны, она будет являться таковой ровно до того момента пока угроза (в данном случае наркоман) не будет нейтрализована и преступление не будет остановлено. Если условно он нанес 9 ударов и угроза была устранена и больше в сторону обвиняемого не было произведено «подавляющих» агрессию ударов , то с вероятностью 90% его действия оправдают и будут оцениваться как самооборона. А с другой стороны если после устранения угрозы (которой условно хватило 2 удара) продолжает дальше месить наркомана то тут уже сложнее будет доказать тот факт что это оборона , а не применение чрезмерной силы (даже если в первом случае наркоману пробили голову, а во втором он просто в штаны насрал и отделался испугом) или даже нападение
